Apply EAD and AP at Local Office??

Hi, all,

My I-485 got interviewd but still pending due to name check. I need EAD and AP for travel. I was told by someone that I need to file applications with the local office, not the VSC.

Does anyone have experience on this? Do I need to use INFOPASS to get an interview for this? What is the comman procedure for this? Can I still use the E-Filling for the EAD?

I can't answer all of your questions but one thing i know that my I-485 is also transferred to the local office and when it was time to reapply for EAD, I 've mailed it to the National ceter and after a month I've received a mail from national center that they have transferred my application for EAD to the local office. So I've lost one month there. I was confused as where to file it, so I've filed to the National center. But I advice you to file at the local center since your I- 485 is there. May be someone else here can answer your other questions.

Got a reply from FBI but no good luck

Hi, Compass,

Seems our cases are in a very similar situation now. I got a reply from FBI on my email sent at end of jan, 2005. No good luck and the status is still pending and blah blah. I also found out that the name checking request was recieved in March 2003. So, it has been more than 29 months already !!! I don't know how long this is going to take ...

You must apply at the Service Center

  1. You must continue to file at the Service Center, even after your original I-485 file is transferred to the local office.
  2. If you file directly at the local-office, you are counting on your luck. Either the local-office will approve it or will ask you to file at the Service Center.
  3. When you file at the Service Center, it will forward it to the local-office, provided the local-office had tagged your A# at the Svc Center level to forward to it all applications that may be filed by the applicant. IF the local office didn't request that your files be forwarded to it, then the Svc Center can go ahead and approve it after verifiying that you have a pending I-485 at the local-office.
  4. So all this means, you must plan for the very possible transfer from Svc Center to local-office and must apply sufficiently in advance.
  5. In my case, I have now gotten 4 EADs and 4 APs, out of which only 2 were approved at Svc Center level. For APs, 2 of my AP applications transferred to the local office got approved at the local office. However, 3 EADs were approved by TSC and one EAD which was transferred by TSC to ADO got approved at Missouri Service Center (MSC) after ADO in turn transferred the EAD back to MSC for approval. Local-office can approve only interim EADs and only service center will have to adjudicate permanent EADS for employment-based candidates.

I think this could be dependent on which local office you are working with. I am assured by my attorney three times that my local office will issue the EAD card at the same day when you get an appointment, and the interview has to be within one week before the expiration day of the current EAD. I did voice my concern for such a short time will not allow me any alternative if any thing goes wrong at that day. But my attorney told me there is no problem at all and they have being doing this very regularily.

So, I count on them.

However, my local office will not accept AP application at all. So, that is also another proof that these regulations are indeed different from place to place.

I just applied to VSC for 3 EADs. Received a notice for spouse, waiting for the transfer.. nothing yet for me and kid yet (applied these 2 EADs a week later). I think they will transfer all 3 applications to the local office.... will update you when I will have any news...

You are absolutely right and what you are doing is risk-free and is according to Hoyle. This is exactly what I had to do when TSC transferred all APs to local-office for interview and approved one EAD at TSC while transferring the latest EAD to ADO. ADO then transferred back the EAD to MSC, while granting me an interim EAD due to the 90-day limit.
 
Oh my God! They even transfer back and forth.... wow... I was hoping for just one transfer.... anyway, applied 3 months and 2 weeks before expiration the old EADs....

Yes, in my case, after my I-485 was transferred, I had filed for 2 EADs. One was approved at TSC after issuing an RFE and the other EAD was transferred to ADO for interview. After I went to ADO for the Interim EAD, they issued it even though they told me that they cannot issue permanent EAD for one-year. After they issued the Interim EAD, they transferred my EAD file to Missouri Service Center (MSC). I got my permanent EAD from MSC directly!!!!!

TSC had also transferred TWO APs to ADO that I had filed at TSC since my original I-485 transfer. However, ADO approved both of them without any interview.

So, if EAD gets transferred from Service Center to Local Office, it may either be approved or transferred back to the originating Service Center or some other Service Center with less workload. However APs are approved by the local office in a tepid MS Word document that is erastz at its best giving curious onlooking by the custom agents at the border!!!!
 
E-Filing is a better option

To avoid this kind of shuttling between TSC and Dallas district office, I e-filed my EAD application and got a confirmation with MSCxxxxxxxx. My EAD was issued by National Benefits Center in 60 days.
My son's e-filed AP was approved by National Benefits Center in 50 days.
Hoping to get my e-filed AP approved soon ( It has been 42 days already)
