Appling I140 & 1485 when H1b Extension pending..

My h1b extension is still pending. it may take 1 more month.

Do i have to wait till i recieve my h1b approval or
i can apply I140&I485 with my h1b extension receipt notice(my old I94 expired) ?

If i apply I140 & I485 with h1b receipt , i may get RFE regarding new I94 date and approval notice ?? is this true ??

which way is better ??

please let me if any one gone thru same situation.

No, you do not need to wait. your h1b extension receipt notice is just fine though your old I94 is expired.

My case was same and I did not get any RFE for anything. My h1b extension came very late (So, it is better not to wait for extension approval). I got my I-140 approval after my H1b extension so it was bit of delay but that is ok..

Go ahead and file your I-140,I-485 with your h1b extension receipt notice.

h1b transfer is not approved

My h1b transfer application is pending. Can I file for I-140/485 with my company. My h1b was filed from texas and may take 3-4 more months.
Do I really need to wait for 3-4 months.
I have receipt notice and paystubs.

need advise

i applied for h1 extention, i got a query ,INS needs more evidence on my case(like latest tax returns)and my I94 expired on feb 5th2004, here my wife's labor for GC approved on jan30th2004.
i have time to answer the query up to march 27th 2004.
mean time can i apply 485 through my wife, before submiting answer to query. i am little confused.
