Applied for Naturalization BUT was out of status:

Hello everyone.

As some of you guys know that currently i am waiting for my oath over TWO months .... and still waiting......

One thing came into my mind which i assume could be the reason for delay in Oath is...

The officer during interview asked me if i was EVER out of status , which i was before i got married to USC. i said yes ...he asked if there is any Deportation pending against me.?...I said NO...

he flipped through my A filed and said...OK...we'l have to check for your another file, to see if one exists.

what ne meant was to make sure if there are any deportations pending for me or i was ever issued deportation .???

name change during N400 could be reason for delay aswell,.

but what u guys think regarding what axaminer asked me...???

I'm out of status,but i apply under president Bush executive order because i was in the Army from july94 to may 02.

interresting, I believe you must be a Legal Permanent Resident to apply for naturalization or to be a member of the armed forces. The provision to apply for naturalization under the Presidential executive order waives only the residency requirements. Keep us posted!

First poster, if you were out of status at some point in your life but have had properly adjusted your status since and fullfill all the other requirements for naturalization, the out-of-status period will not be hold against you (shouldn't be!). A two month wait for your oath date post your interview is not unusual for some locales. So hopefully you'll hear something soon. Good luck!
