I am a 24 yr old International Medical Graduate in India. Around 2-3 yrs back my maternal uncle (who is a US citizen) applied for green card for my mother. My mother (being his sister) and my father were eligible for the green card via I-130. But me being over 21 yrs at that time was not eligible. But inspite of that my mother also asked me to fill up a form and she sent it along with her file and they accepted the fee for my application too (even though I was already ineligible).
Now, however, I have been appearing for the USMLE exams and the USMLE step 2 CS has to be given in the US. For that I need a non-immigrant visa (probably B1/B2). But, I have heard that with a pending immigration petition I will not get the non-immigrant visa.
So, what should I do? If I voluntarily withdraw my I-130 application will it help (especially since I wasn't eligible for I-130 in the first place)?
Also, inspite of withdrawing does it have a potential to reduce chances of me getting a student or tourist visa?
