Application Pulled from regular processing

Hi,

Has anyone had this.

My attorney found out today that my application has
been pulled from regular processing to undergo additional security check.

According to the attorney it will take VERY long before the case is put back to to the regular processing. Any ideas as to why this would happen. I have no clue why this was triggered.

How long is VERY long? Any one in similar situation.

I'm freaking pissed and fed up of this greencard crap now.
 
This is the first time I am hearing something like this.Doesn't your attorney know why this happened?You should probably ask him to check with INS

This is news to me. Hard luck! Can you ask your lawyer to find out what they mean by additional security check? Or is it more of the usual INS smoke and mirror game, where they have lost your application and are bullshitting you to gain some time while they find it.

They might have got a name match (or partial match) with your name against one of their "bad guys" lists.
 
I hope your Lawyer isn't making up a excuse to keep you off his back ! :o

Have you been pushing your lawyer for the current status or did he check on your application on his own?

Whats your current status ? Wac no ? Any RFE / 2nd FP yet?
 
Yes it happens in some cases, I have friend who applied in EB1 and when called the toll free # they told him that his file went to Missouri( not quite sure of the place) for additional security checks this happened long back may be in October 2003.

It is still a mystery to him and no more information is available.

I am still on H1

I had an RFE for EVL which was responded on Oct. 31, 2003.

I did push my lawyer for the status. THe lawyer had inquired a month back.

Am not sure if the lawyer calling INS again and again screwed things up but sure sounds like that i am screwed.

Hang in there! Here is a plan of action:

1. Get in touch with your Senators/Congressman's office and ask them to investigate the casue of the additional security check. Atleast you will know why you are going through this mess.
2. Fax INS and ask about the status of your case. That way they know you are alive and pissed.

I hope things turn out for the best. We are all rooting for you.
 
Just had a detailed talk with the lawyer. According to the lawyer it might have been my name since I have no other reason to have such a trigger.

According to the lawyer there is no way to inquire whats going on in the security check and there have been cases where security check goes on for say 1 1/2 years.

Man I hope none of you have to go through this shit....

I guess I'm packing my bags to go back to desh... This is a pain in the ass. I was better off home. This is really testing my patience now.

And here's the best part after the security check, I go back to the regular thing i.e. its upon dear mr/ms IIO to then approve my case whenever he/she feels like....

I guess I'll check back with this forum after 2 years.

You have already been through enough pain a little more will not be lethal. One apppoach is to see if you can have an appointment with BCIS officials working on your case and:

1. See if you can help them by providing additional documentation etc to expedite your case.

2. Get a confirmation on why amongst so may other cases only yours was pulled out. They may come back with "this is a random pick" to which you may need to prepare a suitable response.

As a backup, you may explore Consular processing, if that's applicable.
 
Thats a great suggestion about CP. Never thought of that. Have asked the lawyers. Lets see what happens.

This whole thing was a result of a fax so I don't think an interview with the BCIS folks is going to help at all.


But great suggestions.. Thanks for thinking on my behalf. ('coz i'm almost brain dead in ins matters now)
