I have a question I have not found much info on. An applicant for permanent residence (through marriage), who has struggled with a mental health issue, was at one point brought to a hospital emergency room after a 911 call for suicidal threats/behavior. He was released after two days in the psych ward.
Since mental illness involving self-harm can be grounds for denial, he is considering not disclosing this issue. The question is, would USCIS discover this anyway? Would/Could they find his hospital records, 911 records, or Police records? A small troupe of police (maybe 5-7?) did come to the house - it was mentioned on the 911 call that he knew martial arts and could react badly - but actually there was no altercation, and certainly no fingerprints or arrest - he was just brought to the hospital.
He did speak to one lawyer about this, and she said they would never come upon his hospital records, and that even if there was some police log of the event, it would probably not come up in a USCIS check. But, she wasn't actually certain.
Does anyone here have better information? He is afraid, of course, that if this is found out he could be rejected, and furthermore prosecuted for lying (if questioned on mental health at the medical exam and he doesn't mention this). OTOH, if he does disclose, he could be rejected anyway - and even if this would be forgiven, he could be asked to produce his medical records from the hospital, where he disclosed marijuana use (and not just one or two times) - which otherwise there is no record of.
