Message for my appeal for I140 changed to

On XXXX, we received this case back from the Administrative Appeals Office. If any further action is appropriate, we will notify you when it is taken.


Is this good or bad? Please suggest.

Can I know your details like service ceter/category/reason for denial/MTR date /sent to appeals date etc.

Why does ones I140 application go to appeals office because one of my friends wife application(I140 -Nurse)went to that office and came back to center but the person who filed is saying that Its something to do with her application and not clearing because she is under retrogessed category.

Is it true ? because as far as I know retrogession effects the I485 application process. Please let me know because this may help my friend a lot whats happenening with his wife application.

Is there anyway he can contact the USCIS to find out the status because when he called they said its confidential and cannot reveal to anyone except employer.

Its urgent please help us !!!!

The employer has to file an immigration petition (I-140) on behalf of you(beneficiary). There are certain guidelines (satutory and regulatory) to approve the I-140 application by CIS. If CIS feels that the information submitted by the employer does not substantiate to approve or deny the I-140 application, then an RFE(Request For Evidence) generally will be issued to the petitioner to send in any additional info to prove the legitamacy within the guidelines. In some cases, CIS may deny the case even without RFE.

If I140 is denied, then CIS will give 30 days for the petitioner to appeal their decission. If the petitioner feels he/she can appeal, then they have to pay some fee and fill in a form called I-290B and send them to CIS with any additional info he/she may have at the time of appaling.

You are right. Retrogression is nothing to do with I-140. You may not be able to file I-485 if you are from the retrogressed country untill the numbers are available.

If you have I-140 case number, then you can go to USCIS website and register yourself with this case number and see the status of the application. If you opt for e-mail option while registering, you will get emails as and when there are any status changes on your application/s.

You try to read some other threads related to I-140 problems in the forum to learn more details about possible reasons for denials and how to fight back the denial decissions with appeals and other important stuff.

Message Changed Again

This case was reopened on a BCIS motion, and the case is now
in process. It is taking between 90 and 485 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

I got RFE after my case is reopened (I-140), have you ever heard of this? Is it a bad sign?
Please reply because you are the most nice person here and it seems you know this the best.

For my case, I applied NIW from VSC, it is denied without any RFE. I filed appeal this Feb, they reopened it as MTR. Now they ask for RFE, how do you think my chance of approval? (I havn't got the RFE letter yet)

This is again about my friend's wife case.

She is a nurse from India and applied for I140 on AUG 2004 from VSC and the message has been changed like the following two times. Basically he didn't get any message from the employer about whats happening with I140 until he asked them recently.They said they approached USCIS since they saw the date was passed by and submitted some info that USCIS asked for.Later the message was changed to 2.

1.On December 13, 2004, this case was transferred to our Administrative Appeals Office for review. That office will notify you of any further action taken on this case

2.On December 22, 2004, your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received here for processing. It is taking between 30 and 60 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

So I wanted to know what is happening with this case?? and Is there any other way that he can find out what is going on with I140 application?

The problem here is she is still in India and cannot come until she gets her greencard(since she applied under Nurse category). My friend also had "Green card" so this was another way to get her here into US than applying as a spouse(because it takes several years to join a spouse who is having greencard).

Can he apply again for another I140 for her if this gets denied again? why the message here says as if they got a new I140?

under EB2 or Eb3 please let me know.
Do u have a ny idea on time frame in AAO for eb3 cases. Please post ur ideas.

as an fyi - i don't see how this approach will get her here faster. Since she is a "schedule a" person and doesn't require a labor certification, her priority date will be the date of I-140. If she applies again and she can, the priority date will be the date of the I-140. Since she would be in eb3, she would have to wait for the priority dates to be current before she would get consular interview. currently, eb3 with priority dates of April 2002 is being processed. Unless, the priority dates move forward considerably, she will be in for a long wait, especially if she applies for another 140 again because she will get caught up with all the people who are going to get priority dates under perm.

Yeah I understood the problem now..But they didn't expect this when they applied because at that time the law wasn't changed about priority dates..Her application got caught and delayed and went in to Retrogess dates.Lets hope for the best and what we can do now is look forward for the Approval as the message changed .

Guys, please comment on my case. My NIW case was deniled, but reopend after appleal. Now they ask me for RFE----the most weird thing is the RFE letter look exactly as the denial letter (Same sentence like publication itself does not mean-----the citation----), but it changed to ask for more evidence instead of denial. It seems like they did not look at my appeal stuff at all (I submitted citation report with my appeal letter and some new materials including a new recommendation letter), but why did they reopen it then?
Oh, My, I am so tired of this. I feel this is so endless and hopeless.What should I do?
