I applied two i-140EB1 sponsored by the same company but in two separate categories
(a) Outstanding researcher
(b) Outstanding business person
Additionally, as soon as the concurrency provisions were passed last summer, I filed *one* concurrent i-485 (September 13, 2002), tied to (b) Outstanding business person i-140 application. The reasoning behind this is that both my lawyer and I thought (b) above would have a better chance for approval.
Ironically enough, out of the 1-140 applications (a) was approved mid July and (b) is still pending after 15 months. The problem is that the 485 is filed with (b). My lawyer has sent a letter to VSC trying to put the two files together. A status inquiry was also placed on the pending i-140 application (since the people on the national hotlines cannot seem to grasp the concept of two i-140 applications).
I would really appreciate some advice. In an ideal world, I would ike to use my pending i-485 which was submitted over a year ago. An alternative is to go the CP way.
Has anyone run into this problem? If so, what did you do?
