(posting for a friend). My friend had to use AP as there was delay in adjudicating his H1 stamping while visiting India. His wife did not file for AOS at the time he did as she was out out station and the date is not current anymore(His PD : Nov' 2003- EB3)
She has a valid H4 stamp till jul of 2010. What are his/her options/scenarios?
did she loose her H4 status?
Will it impact his AOS process, if he files for H1 + H4 now or later?
Or will she continue to be on H4 and he on EAD till jul of 2010 at which time he either files for her AOS ( if the date is current, unlikely or H1) ?
Please give ur input.
My friend consulted his company lawyer who advised him that his AOS will be unaffected if we files for H1+H4 again.
