AP Travel and Extensiion

Hi Folks,

I have question regarding the using AP to travel and extensiion.

My wife is travelling to INDIA by april 1st week and her AP expires in August 1st week.

Can we extend the AP while she is still in India or does she have to come back before her AP expires.

If we apply and get it extended will she have to provide the latest AP or the old one (obviously she would have used old AP when she leaves).

What is best course of action in the above situation?

Dont take any chances..

You cannot extend her AP ...she has to come back before it expires..dont take such chances...if she is out of the country and her AP expires you cannot apply for a new AP...and she could never come back !
You dont need AP to go out..you need it to come back in..and you need to be in the USA to apply for AP..which is permission to leave when you are under AOS.

How long can one stay outside the US before reentering with a valid AP. Is there a limit on number of days that one can stay outside. ?

tt_tt, if we apply for her AP extension now(she is till in USA) and after the approval comes, I could mail it to her in INDIA. Will that be acceptable or any specific clauses/procedures in AP hinder such a course of action.
 
And what if you don't get her approval in time and 485 approval comes.

Ask her to come back before AP expires.

Why are you taking risk, change your ID to saydead.

If you leave the country while the I-131 application is pending, it is considered as abandoning the basis for this application- which is I-485 application.
It is very clear inb the I-131 application instructions.

That is why they let you walk in and apply for AP , ussually approved on emergency basis.

You Can ALSO APPLY I-131 WHILE THE BENEFICIARY IS OUTSIDE THE US. But I do not know the success rate of such applications and the conditions required for it.
 
vipsha, I don't think CSC is approving July 2002 cases yet.

I did not understand the risk involved! Do you mean ppl with valid AP cannot travel at all.

Sheelum, does your argument mean that we can apply for AP renewal only after she returns back(obviously before her current AP expires)

We have made arrangments for her to return before AP expires. The whole Idea was to apply for extension/renewal of AP while she is still in India. So that if needed she can stay longer.
