AP Rfe and travel

WAC 184 RD 04/11 ND 05/15 EAD received(wife only)
Rfe on AP on July 6th Sent on July 11th(for wife only)
Problem is we need to travel outside US in October
Husband has valid H1 Wife was working on H1 and now layed off(theoretically on leave of absence ) H1 visa stamped on her passport valid till 2002. My lawyer says AP will arrive before October !!! and no need to apply for her H4(cost cutting measure may be !!??) and we can travel with EAD+ AP
  Is her h1 still valid ?? she is not getting paid from her employer Can we travel without AP(for my wife) ?? Have heard some terrible stories of unable to reenter. should I apply for H4 ?

RFE for AP

I had RFE for AP on May 25, 01 replied on June 1,01 and get approved on July 31 , 01 . So, it took one month for the approval after the RFE. So, you probably get it before October .
