AP Refused

Today I went to local INS office to request AP, but they refused.

I don't have H1 visa stamped in my passport.

My H1B is valid till October '04. I'm planning to travel to India in July, so practically there will be 3 months before my H1 expires. Will this be a problem in issuing me a visa ?



Please let me know.
 
I went to india in NOV2001, came back in dec01, had H1 extension till 8feB02.
Got my visa stamped in Chennai (drop box), took a week. No issues then.

If you can get your visa stamped in a week in india, you should be fine. But I am not sure about current stampling situation in India. I would suggest, pl apply for an AP as soon as possible, you may get it....
 
I haven't heard of anyone getting an AP in the local INS office !?
I think it is only issued by any of the INS service centers.
 
There are cases where ppl got emergency AP at local INS centers. But for that you need to really show or prove that you need to travel pretty badly like family emergency etc..

Vijji241 did yo apply for AP at Service Centre??
if Yes and if you must have to travel then provide further evidence to Emergency APl .

If no then apply for AP ASAP at Service center
 
If your previous H-1B stamped has not expired over a year then you can apply for drop box, otherwise you'll have to go for an interview.

Local offices, take applictions for AP and give emergency AP's, however, they don't approve AP send right way.

Since you shave so less of a time left, you might want to consider postponing your trip until you get your AP.(if travelling is not an emergency).

For AP you'll pay $165, vs for stamping in India you'll pay $150, which will be good for 3 months as per your visa.
 
I had family family emergency earlier this year. AP was pending for more than 5 months. I went to local INS office to get it as suggested by friends. They refused to give me at local office. Their explanation is...

If your I-485 is pending at a Service Center (mine pendign at VSC), You have to get my AP from there. Local INS can not issue AP since they do not have your file physically.

As was trying to contact VSC, my AP luckily got approved the same day.It's a coincidence.
