Advance Parole or Re-entry, also Queston...

Hello guys,

okay I have gotten two answers from USCIS, one said that I should file for a "Re-Entry Permit" if I want to travel from the U.S. to another country and be allowed to come back to the U.S. while your case is pending. I then called again and a woman told me to file for "Advance Parole" if I want to travel from the U.S. to another country and be allowed to come back the U.S. while my case is pending...So the queston is, ADVANCE PAROLE OR REENTRY? lol.

Okay so I am going to E-File it, I've never anyones experence through E-Filing so is it really quick and easy as "they" say?

Also, there is a queston on the Form that says on Part 1, Queston 3 "Class of Admission" now what I understand it that its a certain visa you came in with...I never came in with a Visa nor a I-94 so do I leave it blank (Canadians are not required to have a Visa nor an I-94 when entering as visitor).

Are you sure filing AP is needed at this junction. Your Interview was in Jan. You should get green card soon. It will take at least 4 months for AP to go through. Maybe it will sooner but not likely so make sure you make the right move.

hmm...well as you may know I did have my interview on the 23rd of January and well I really don't know how long I have to wait til I get an Approval or an RFE (the officer said 4-6 weeks and well were pass that), do you think they will make a decison before the 4 month period?

If you didn't get approved at the interview, it is probaly because of name check or that the IO was not a supervisor and therefore, could not give the final approval. Unless for some bizzare reason, you should have green card in time to travel. You already received an RFE so all info has been collected by USCIS. It is hard to say what will happen. Try calling once more to find out anything about your case. I don't want to tell you the wrong thing to do so you have to use your wisdom.

woo woo no heres what happened. At the Interview (1/23/2007) the officer wanted a Long form Birth Cerfecate and well I didnt have one at the time (I do now) so he then said he needs some proof to know that my step-father and I are relatied, he said "I have the Marriage licence in which thats good but I understand you use to live in the U.S. before through a different case, im going to check up on that and see what evidence was shown there, also get a Long form Birth Cerficate cause you might need it"

Anyways he then said I would receive a letter in 4-6 Weeks in which I would ether get an "Approval or RFE", I HAVE NOT RECEIVED THE LETTER...I mean I have no clue whats going on thats why I was thinking about getting an AP/REP but then I called the 1800 number and they said that it may take up to 90 days from the time of the interview for a decison.

so heres my queston, (advice wise), Should I wait or go ahead and go with AP?

I see your dilemna.  I would advise you to go ahead and file for AP (u always need a backup) The cost is worth having a sense of peace. Yes, don't let everything hang on that one decision. You really need to go to family so do it and even if it turns out that green card comes in time, I still think it would be worth it. Go file now.! It is money well spent. After all its only $$$$, it can be replaced. Best wishes.
