AP question, please help

Hi, All,

I got an AP question here. I used AP this June to travel back to home country. My I-94 has been stamped with paroled to Jun-xx-2007. But my AP will be expired at the end of this August. Can I use this one and come back to USA, say early September? My lawyer said I can use the paroled date, therefore I should have no problem coming back. But I think it makes sense that this expired AP will give me lots of trouble when entering US board.

Could anyone help me here? Why my lawyer is so sure about using AP before the paroled date instead of expiry date of AP? Confused totally.

Thank you in advance,

EMI

You are right to be concerned, since your lawyer is completely wrong. You AP remains valid until the date printed on it - end of story. The date stamped on the I-94 on entry in no way changes this.

If I was you, I would make a formal complaint about your lawyer if you have written evidence of the advice he gave you. If you had followed their advice you could have ended up being refused admission and inadvertently abandoning your AOS.

Thanks a bunch!

Thank you for the reply. It can be that serious?!

Although I did not have any written document about my lawyer's advise (called couple of time to make sure, got the same answer every time), I really put a quesition mark for it. She is in this field for several years; that's why I think she should be right about this matter. But apparently, I am wrong.

So, I think I have to wait for my renewed AP (filed yesterday) then and travel back to my home country later this year.

Thanks again,

EMI

I agree with DMS. Your lawyer advice could have put you in serious trouble as you will not be able to enter USA, no matter what.
