AP Question for Experts- Response appreciated

Does my son, who is 7 years old need an AP to travel into us? Our lawyer says no but I want to be sure.
And, how advace can i apply for EAD renual? My EAD expires June 2004 and I plan to travel on AP so I will need EAD when I return back to India.... (I am traveling July 04)
