AP or H4 ?

I have applied my wife as a beneficiary to my I-485. I
have received my approval, but my wife`s case is still pending.

She doesnot have her AP. I have to go to Canada for some official purpose and want to take my wife along.

My question is- Can my wife travel on H4 Visa (not expired) without AP?


I spoke to my lawyer regarding this and received a reply saying that she can travel on her H4 visa as long as it is not expired.



Has anyone experienced the same problem?

Your wife's H4 status expired when you adjusted status to permanent resident. Se will need AP to travel since her H4 is no longer valid. (If you are not in H1 status, how can your wife's H4 status be valid?)

H4 is tied to H1 and if H1 is no more valid then how come H4 could be valid ?

Once you get approved and stamp on PP thats it, H1 and H4 becomes history.
 
If you have received your approval, then you are no longer on H1, hence your wife cannot be on H4, ergo, she cannot travel on H4! Don't even risk it! It is too dangerous!

Better wait for AP or apply for emergency AP to travel!
