AP not received - Travelling to India in the 1st week of Feb

Hi All,

We applied for AOS On Sept 29th (The rush time!!). I got my EAD and AP on Oct 31st. My wife received her EAD in the 1st week of November. But, she is yet to receive her AP. We have planned our travel to India in the 1st week of Feb. Any suggestions what we should do considering we have less than 3 weeks. My wife is the Primary and I am the secnodary.

Her Visa is expired and we don't have an appointment in Indian consulate. So, we badly need the AP to travel to India.

Any suggestions if she can walk-in and get AP? Or does she need to take appointment?

Strange. The derivative received the AP but not the primary applicant. Also, you seem to have applied 3.5 months ago, so timewise the AP approval should have come already. Try calling USCIS first. If that does not lead anywhere, schedule Infopass appointment and meet with a USCIS rep. in person.
 
Which center did you apply to?? NSC/TSC are pretty quick in approving AP.

A thing to note here is that many times they send the AP to your lawyer rather than you.

Also What does your online USCIS account message say for AP - Is it approved??

In case it is approved, and a month has elapsed, then there is a very good chance that your (dumb-as*) lawyer is sitting on it, without telling you. The same thing happened to me and the lawyer gave me the AP only once I asked him to file an enquiry into why the AP hasn't been received in mail - although it was approved a month ago.

Good point. It may already be approved and your lawyer is the problem, not the USCIS. Do you have the receipt number so you can check online if it is indeed approved? In other words, is the problem that AP is still not approved as verified by the USCIS throught the receipt number?, or is the problem that you just have not received the AP from the lawyer yet without knowing if it is indeed approved or not?
 
The best thing would be:
- Check your case status online (using your case number), if you see "no update OR LUD did not change" (as most of the time they don't update the status though they had already processed/approved it), then try to confirm the same thing by looking at the service centers "processing times", the report that came out on 6th January for your service center (CSC, VSC, TSC etc etc). If you see that your AP notice date is way before than what they are currently processing, THEN THE CHANCES ARE HIGHER THAT, your case is approved but sitting with your lawyer.
- Send Email to your lawyer of what you had researched and let him/her know why your case is still pending. That way he will reply back to you very quick.....

Thank you so much for your replies. I called USCIS this Monday and they said they are currently processig oct 25th AP. Our receipt date is indeed 25th Oct. I will wait for one more week and see what happens
