AP issue--Realcanadian & others

Our family have I-485 pending since 2004, but our nonimmigrant status, H1/I-94 and H4/1-94 have expired this year. Can we return to U.S. after traveling abroad with valid passports and valid APs, but with expired I-94 for nonimmigrant status H1/ and H4?
The immigration officer at the port of entry is from USCIS or CBP (Customs and Boarder Protection)?

As long as you each have a valid AP before you leave, you will be fine. The I-94 will be surrendered when you leave the US, you won't have it with you when you come back, and will fill out a new one on the plane.
