AP/H1B urgent travel to India

Hi,

I have bought tickets for travel to India with travel date of Oct 3, 2007 and I can’t delay this travel due to my sister’s marriage in India. I am not sure if I will be able to get AP by then considering the slow AP processing at NSC.

I am planning on following…

1.If AP is approved by Oct 2
I will have it sent to me by FedEx in India and I will use it for re-entry

2.If AP is approved on or after Oct 3
I have an H1B approval valid for next 7 months and I am planning to get H1 visa stamping done in India during my vacation of 3 weeks and I will use it for re-entry

Please let me know if you have any suggestions/advise.

Use H1b

Rahul,
You can use your H1B visa stamping to come back to US if it is still valid and you will be fine.

Hi,

I have an H1B stamp on the passport from an old employer valid till Oct 2008.
I have an H1B status valid till Oct 2008 from my new employer.
My I-485 is pending for the namecheck.

Can I travel to india in december 2007 and return back without getting anythign stamped?

Wait for AP or get H1B stamp

I'm also in the same situation. My AOS was applied in August and I'm in my 9th year of H1B extension.

I'm planning a trip to India on Nov 19th and not sure if I should wait for my AP documents or get my H1b Visa stamped from the US consulate in India.

Also does any one know if I will be eligible for Emergency appointment as I will be coming back under working in US category.
 
If you must go on Nov 19th, then your decision is already made: If you get your AP before you leave, then you can use it to come back. If you don't, and you leave the US before you get it, then you will have no choice but to renew your H visa in India.

As for emergency appointments: those are for people with a serious emergency, i.e. a death in the family or close to that.
