I am currently on a H1. My husbands I140 has been approved. We are waiting on the I485. We have sent our EAD and AP papers for renewal. The 90 days are not up. Since I have been on H1 for sometime now, I have not used my EAD or AP till date. The problem is I have to travel to India for a 6 week business assignment in April. My H1 is valid till September 2005 and I have all the necessary stamping. What should I do to get an AP before I travel if it is not approved as yet? Would there be an issue if I travel on H1 and my I485 gets approved in the next two months? My husbands I140 got approved on Feb 24 2005.
