Hi all,

Our 485 is in process for the past 2 years and this is my second AP I have applied for. I have applied for my sons AP just 2 days back thinking I will make my trip towards the end of the year. There is an emergency which requires me/my son in the month of July to go to India. It is next to impossibility for me to get my son's AP before that . My AP is still valid till October.

What shall I do?

Can I apply for his H4 ? What is the current processing time for H4 assuming I submit it in a matter of 7 days.

Any information will be helpful.

I think now the processing for ead/ap becomes fast, reducing backlog of 485s you may mostly get the AP by end of June, alternatively, you may try for your son for an emergency AP. Some locations you may get the ap, it all depends on the center/officer/luck.

I know I might sound crazy/desperate. But with TSC, they can drive a person up the wall and insane !!!

Is it a good idea to meet the local officer now, or should it be at the 'neck of the moment' in June? Any answer will be appreciated ..

The dates in the gov website for AP is Oct 22nd, 2003. But I belong to TSC...anything is possible. I can get my AP tomorrow too. The only thing which TSC still has not achieved is - to read a persons mind well in advance and issue whatever we need. Otherwise, I guess we have seen all permutation/combinations of problems in this forum .
 
You are right and agree totally with you, you may try to go local office sometime in June timeframe. H4 may be another option, no idea of processing times for H4. Another option you may send fax request for expediating the case after sometime. Good Luck.

Currently the H4 processing is not that slow. You should get it within 2 months from the current processing time at TSC.

I am not sure whether I can apply for H4. Is my son eligible to apply for H4 when we are in 485 stage? But his H4 expired a long time back as I heard 485 is what that is valid.

My hubby/myself are working on our EAD's. So, is it possible for me to try for H4 for my son? Should'nt I be in H1 to apply for my son's H4?

I shall not suggest you to go for H4. Most probably you will get the AP by May end or early June (I read it some where that they are trying to reduce the time for AP to two months). If not, then could send fax to expedite the case and if in the worst case, you don't receive by the end of June then you might request for emergency AP to your local office.

Few question before your questions cd be anwered.

With best of my knowledge:-

1. Do you have VALID H1 ? If you have valid H1, your son should have valid H4 too. Generally H1 and H4 are applied together.

2 If you don't have valid H1, you cannot apply for H4 for your son.

So that leaves you with the option of AP.

If there is real emergency, local office can issue AP - you got to have convincing proof.

If your son's H4 has been expired, I don't think he can get H4 renewal again. What is his status now? AOS right? I don't think you can switch from AOS to H4. So, the best way for you is to apply emergency AP for him. It's only my opinion.
