AP expiring + traveling abroad. Question abt renewal.

hi,

My AP is expiring in Dec 2003. Planning to travel outof country and back by Jan2004. So planning to apply for the AP renewal.

My receipt date is Jan02 and should be receiving the approval (hopefully) anytime. Should the passport stamping be done only in US or can it be done in the embassy anywhere outside US?

Lets say if my AP has expired but i have the approval notice. Will this be a valid document to enter the US?

Please clarify. Thanks in advance.

I'm in a smilar situation...

I've used AP many times over the past year and a half....I just applied to renew my AP today...My RD is feb 7th ' 02. Let's see now...given that we are pretty close to getting our 485 approved (say 2 months - at best !), normally, if you are planning on leaving the US temporarily in Dec'03 or Jan'04 (vacation or whatever), you could wait without applying for an AP but then knowing how theres clowns at the INS work, it's better if you apply for your AP and sit pretty.


Just do it...what do you loose ?

But, Dont try things like going back to..(say India)..and walking into the US consulate there to get the GC stamped...just try to do things straight...serious.

Checked the BCIS site and they have few info in RED color (to freighten us i think). It says :

"Due to recent changes to U.S. immigration law, travel outside of the United States may have severe consequences for aliens who are in the process of adjusting their status, extending their nonimmigrant stay, or changing their nonimmigrant status. Upon return, these aliens may be found inadmissible, their applications may be denied, or both. It is important that the alien obtain the proper documentation before leaving the U.S."

Any comments on this? Are we not encouraged not to travel outside of US if we are in pending i485?

But Edison, how long you will wait for your approvals. The BCIS approves some cases after your date also and yours you dont know when they will touch. So sometimes we might hv to travel.

Anyway it is individual decision.

Can we file AP renewal at the local INS office or it has to be mailed to VSC ONLY ?

send it to VSC. It's a pretty simple package you need to put together. It's nothing at all !!....

put together a cover letter

download the old-ass copy of I131 - fill it up - usually takes no more than 5 minutes

take photocopies of your i485 - old AP - EAD - all pages of your passport (and your i94) - 2 pictures - a check for $110


that's it !!... send it to those fools by USPS priority mail (certified) - less than $7.....sit tight...suck it up...you should get it in a month or two.....that's it.

finito !
 
Or try getting Ap at local BCIS centre, take all the document listed above !! Should not take more than few hours !!

Every time when you travel back to the US, the border INS should stamp on your AP; the stamp should give you 364 days of life with your AP, from the date of entry or stamping.
