AP expired - can use H-1B for travel?

Hi guys,

My AP is going to expire in December and I have never used it, but my H-1B is valid for one more year. Can I use my H-1B to get the visa in my home country and use it to enter US? My AOS is still pending and I have just got an RFE for more documentation (like tax forms, W-2 etc...)

You bet, you can. if you did not use AP, your H1b is still valid. In fact you are in H1b status. So you are eligible for H1b VISA. Make sure that you have enof time to get VISA. Now a days ppl dont get VISA right away he or she apply. depend on countries. Make it sure with your lawer.
