I have applied my first AP at TSC during July'07 fiasco. It was approved in September and I never RECEIVED it.

I was suggested to reapply at InfoPass appointment and by TSC IO's.

I applied my second AP in December'07 and it was Denied in January'08 based on 120 days rule. The deniel notice says we should not apply before 120 days of the expiration of the existing AP.

What are my options? Can anyone suggest me how to proceed?

Did CIS cash your check? Did you get receipt notice? Is it a reject (return your package with your money) or denial (denied without money back)?
You'd better call CIS for your situation and ask CIS to re-mail the 1st approved AP.

There is a big difference between denial and rejection. If the case is rejected then USCIS won't cash the check.

In my case TSC accepted my AP application, cashed my check and they took almost 30 days to deny. I did't get the receipt notice.

I called several times and got different answers. Actually the denial notice
says there is no appeal to this decision.

Do you know the process of getting 1st approved AP?

Ask to re-send

If your 1st AP got approved, but you did not receive it, you can request CIS to re-send you another AP approval notice without any further payment. Print out your appvoal notice from online and mail it to TSC 131 P.O.Box. Write a letter to address your issue clearly and politely. Did you move after you filed your 485 application? If yes, you need correct your address first.

If the AP documents were returned back to USCIS then only they will issue duplicate copy otherwise they won't issue.
I did not moved after filing I-485.
 
If you request a duplicate copy, you will be charged for extra copy, but someone on this forum had successfully request a copy without fee.

Yes, I should have filed I-824 but at that time the processing time is 6 months. That's why I applied new AP.
Is there any way to get the 1st approved AP other than filing I-824 ?, Thanks
 
As I said earlier, if you are lucky to talk to a nice IO, s/he may re-send you another copy of your 1st AP approval and try to explain it is not your fault, like no address change. Additionally you can talk to your congressman for help on this matter.

I am somewhat in ur situation,not exactly.My husband filed in Aug for EAD ,TRAVEL DOCS etc for which both of us got EAD cards and APs from a different employer .Then in DEC our present employer s I140 got approved so we applied 2nd time for EADs ,AP and we both got our EADs and and my husband got his AP because he got 2 different Alien Numbers and my AP USCIS denied saying i cant renew my AP before 120 days.USCIS gave me the same Alien Number.However my husbands Alien number is consolidated to 1 Alien number ,that is the one in the present Receipt number.At the local office during the Infiopass appointment officer said i cannot use previous AP since my previous I140 &I485 are withdrawn.My lawyer sent in a certified mail explaining INS that it is not a renewal ,and this AP is for the new case with new receipts and INS sent back the package to my lawyer.We took another Infopass and went to the local INS and officer said that she sent an email to INS.How to go about now ?PLease give ur valuable suggestions.Thanks in advance.
 
Hi,
I think you can reopen your case within 30 days of the denial date. I don't know how but your case is entirely different than mine so better consult layer.
 
Thanks for ur reply.Like i posted mt attorney sent USCIS a letter and documents explaining the whole thing and USCIS returned the package.
