AP Big Problem, please help

I am in big problem, please help....

I was unaware that the AP should be approved before leaving country and my wife has already left the country and her old AP was expired before she left and we applied for new AP before she left.
I came to know after that it is a huge problem and she may not come back to US, please suggest................ .
Has anybody expereinced similar kind of situation?

You are in big trouble.
Does your wife have any visa stamp?? I presume that you are on H1-B. If so then ask her to go to the consulate to get H4 stamping( If you are on H1 and not on EAD ).

Nope, No valid H1, i am on EAD.

I tried to find any alternatives or something with Attorney but couldn't find anything.

Did you talk to the lawyer about the FTJ CP option for your wife? It is a possibility. Or If you can somehow get her either on L1 or H1 then its another possibility. Other that these I have no suggestions.

Big problem

He mentioned that just keep your finger crossed for now and wait, sometimes POE officers doen't know about all the rules and she may enter, but if will do somthing then it may raise a red flag.
He mentioned that we will explore other possibilities after she got denied to enter in US.
What is FTJ CP?
I don't know what to do as per now......
