My wife applied for her 2nd AP. The ND for the AP application is 10/24/02. An RFE was issued on 11/26/02 and INS received the response to the RFE on 12/17/02. Her case has not yet been approved. Everytime we speak to an IIO we are told that it has not yet been re-assigned to the officer who requested the additional information. Has anyone else had a similar experience? The funny thing is that we never received this RFE as the postal dept. lost it in the mail. We had spoken to an IIO at TSC who told us that the RFE was for a copy of the I-140 approval notice. She took down the receipt number for the I-140 notice and said that she would email it to the officer concerned. Suddenly on 12/17/02 we noticed that the AVM had changed to "we received your response to the RFE and processing has contd...."

AP RFE's & I 485
The same thing happened to me. I filed AP's for myself and my wife sometime back on Nov'01. At that time my wife got her AP but I didn't get it. I waited for 1 year I didn't get it. Everytime when I contacted they said my case has been transfered to local INS and you will get a response from them nothing happened. My lawyer said no use. You file AP's for you two again. This time the case is little different. The notice date is 11/21/02 and receipt date is 11/20/02. They sent my AP. But in my wifes case they asked for some RFE and they sent the notice on 12/13/2002. So far my lawyer didn't get the RFE. I spoke to IIO twice this January they said they don't know what the RFE is about. But they said the notice is sent on such and such date. I am really confused. What can I do now. Is there a way to find out what is on that RFE. Other centers there are less issues even for 485. But here in TSC for everything there is an issue. My 485 receipt date is Sep'01. So far no FP's. Everytime IIO is saying wait for another year. When all this mess will be cleared. Total frustration.

Along with a completed and signed application, you need to send them a copy of the I-485 receipt notice, copy of I-140 approval notice, proof of status (such as copy of EAD or I-94), 2 photographs, a check or money order for $110 (please check the INS website for the latest fees), letter explaining the need to travel out of the country
Most importantly, you need plenty of luck with TSC
