AP and I-94

Hi,

Both my husband and I have H-1B visa. I got AP through him. I have some questions on how to use AP:

1) Should I give my I-94 when I leave U.S.? Some say yes, but our attorney says "If the I-94 is attached to your I-797(H-1B) approval notice you should not give it up. CIS will know you have left when you return". Any idea?

2) Should I fill out a new I-94 form when reentering U.S.?

3) Should I bring my paystubs as well besides passport and AP?

Why just use your H1B visa instead of AP since you are both have visa
