hi,

I went to Mexico and entered on AP. Had no problems at immigration. But they took my old I-94 (which was given to me when i last entered on H1) and gave me a new I-94. The new I-94 is valid till the time the current AP expires.

(1)Is this normal?

(2) Once my AP expires then can i stay in US?

(3) I'll definitely apply for a new AP but I wont get an I-94 with the new AP - right ?

Yes

Right, you will not get a new I-94.

I-94 is basically an entry, exit tracker, which allows the INS to know when the visitor left the country.

AP is a travel document that allows you into the country. But unlike other travel documents like visa's (H, L, J, F), the AP is based upon AOS/485. So your legal status in the country unlike other visa owners is not dependent on the duration of the I-94.

Ergo, you shouldn't bother about getting a new I-94, and you don't need to apply for AP to stay in this country, (unless you plan to leave the country for some time and reenter before your AOS is approved).

Good luck!
