I'm currently on my 7th year H1B and used Advance Parole to enter/exit United States as my H1B visa in passport has already expired. After my recent marriage, I intend to apply for H4 for my wife. My I-797 petition expires in Nov 2006.
I read in this forums(and murthy.com) that you can still be on H1 even if u used AP to enter the country.
So, do I need to get a H1B stamp before my wife applies for her H4 or
is it sufficient to just show the I-797 document and other proof of document at the Chennai consulate?
