AOS without interview?....

Anybody hear about INS approving AOS I-485 family base applications without an interview? Is so could you please post your experience or how INS determine if they need to interview people for AOS, I hear some employment base AOS are done without an interview but I have yet to hear anybody who is getting an AOS for family based get approved without an interview. Any infor would be apprciated.

I don't think it ever happens. They have to establish validity of marrige, at least symbolically, and it is not possible without actually looking at the people who are supposedly a couple.

It's official CPR without interview (Philly)!!!!

Hi all,

I just wanted to let everyone know that it is now official. My Irish hubby and I went to Philly yesterday and he was able to get his I-551 stamp in his passport without incident. We made our infopass appoint showed the officer the approval letter he had been sent and she gave him the stamp. She told him that 90 days prior to his 2 yr anniversary he had to file for removal of conditions and that he won't get any reminder letter. His official status as a CPR started 3/29/05...3 days prior to his EAD expiring. The officer took his old EAD and the approval letter We wanted to keep them as souviners, oh well.

I just wanted to allay any fears that there was a mistake or something since he never had an interview...turns out it was all okay. It is possible to get by w/o an interview, yay!!!!!

Thank you to everyone who's helped along the way. I'll still try to visit to help where I can...Philly changed their format right after we applied and since we didn't interview I wouldn't know what to say about that.

Good luck to everyone still in the midst of the process...I'm sure I'll be back with many questions in December 2006!!!!

Thank you for the exampe of AOS without an ineterview. I knew INS was doing that but didn't know anybody that it happen too. Anybody else please post your experience. Thank You,

There's no need to get personal. No offense, but I thought this forum was for posting information, not tirades against fellow users.
 
Yes please no personal tirades. Everyone here is just posting there experience and information. In fact I also did not know that you can be approved without an interview for AOS. This is kind of interesting. Thansk for the info and please relax.

Sec. 245.6 Interview.
Each applicant for adjustment of status under this part shall be interviewed by an immigration officer. This interview may be waived in the case of a child under the age of 14; when the applicant is clearly ineligible under section 245(c) of the Act or 245.1 of this chapter; or when it is determined by the Service that an interview is unnecessary.

I can't seem to find the memo from August 2002, just a reference to it.

From my read of these it sounds like interviews are only waived on a case by case basis, most often for employment based applications. The only potential interview waiver I've been able to find for family based is if you're a K-1 and you file within the 90 days. Even with that it's no guarantee as I've seen postings about K-1s going for AOS interviews.
