I am switching from AOS to CP under EB2.
Filed I-824 : ND 10/29/03 with NSC.
I-140 approval 10/03/03.
I-485 ND 04/08/03
EAD approval 10/09/03
H-1b visa extended and currently being revalidated.
AP - did not apply for it.
Current NSC I-824 processing date - 09/17/03.

After I-824 approval:
What happens next?
How long does it take to get regular CP interview after that point?
Should I go for AC-140 versus regular CP?
(I have collected all the necessary documents for AC-140 - PCC, etc. and I come under Bombay consulate which accepts AC-140).

I am debating between the two - please advice!!!!!!

Answer: Since you fall under bombay consulate you do not have to wait for i-824 approval. You can follow AC I-140 route based on i-824 receipt. Once your attorney mails your AC I-140 packet to bbay you can expect to get an interview within 4 months!

Answer: You should have proceeded with AC I-140. If you had done on receipt of i-824 receipt back in november 03...you could have expected your cp interview by march 04. Anyway nothing much is lost....proceed with AC I-140 route. If mail all required documents that form a part of AC I-140, you can expect to get an interview 4 months from the time that packet is mailed to bbay!
Waiting to do regular CP would simply mean delaying your cp interview and wasting time. Proceed with ac i -140!!!

thanks for the advice. Will proceed with AC-140.
After 140 approval, I had to wait for Police Clearance Certificate for quite some time. Got it recently.

I guess, you don't need to wait for Police Clearance Certification to send AC I-140 and the same required only at the time of consulate interview. Please correct me if I am wrong.

Ramkgb:

You are right about not requiring PCC as a part of AC I-140 packet. But at the same time, it is one of those documents recommended. Some attorneys prefer including PCC in that packet while other lawyers do not include it since it is not a required document.
