My tourist visa expired in nov 2004 and I got married in 2005. My husband is a US citizen. We have not applied to adjust my status yet. Will my overstay complicate my case? Also is it true that I will only be able to visit my family with a permanent GC? Please help.
Your overstay is pardoned once USC files I-130 on your behalf along with your I-485 AOS package.
DO NOT LEAVE the country until your case has been approved and you receive your GC or stamp,
Be sure you start working on getting all the support evidence together for your case. see attached
My wife entered under visa Waiver program & was out of status for almost 2 years before we applied for her AOS. ( she was pregnant just befroe her 90 days expired and could not travel in her condition.)
