AOS Pending/I-94 Expired - Urgent Help.

My AOS is pending with NSC for more than 10 months now.. My H1B and hence I-94 expired last month. Have a valid EAD. Same case with my wife.

I-94 expired does not mean that we are out of status right? As long as an AOS is pending we are in valid status right? Please clarify.

The reason I am asking is, have to take my wife for a driving test and they normally ask for a valid I-94. What proof we can show for the valid status? EAD/485 receipt?

AS far as I know they do not need the I-94, they need some kind of picture ID. You can use your passport as ID and to be safeside keep the EAD and I-485 receipts with you. To renew the drivers license they ask you to show the proof of valid visa. So do not worry. You are in status. Good luck!

Thank you very much for your reply. Just a clarification. Visa expired last month. We have a EAD/pending AOS. They should accept this right?
 
EAD Works

A valid EAD works, they look at your passport and if the Visa is expired they ask proof of your legal status and you can then show the EAD. My wife received the license on EAD, and our visa expired last december.
