AOS package to Chicago only when number is current ?

Hi Everybody !

Do you think its a good idea to send package to Chicago only when VISA number is current?
Mine is EU00004XXX.

So should I send it in October or wait till Nov ?

Hi, this is very tricky....There are some examples like BORYA in this forum.He submitted his case before and got through without any trouble and there was also an example of someone got rejected after interview because his/her case were not current at the time of submission.

Choice is always yours but my suggestion is to wait till November!!!

My number (2007AS00001xxx) will be current in November but my lawer Planning to send in October as they already publish in advance for November cut-off number on the Visa bullatine. I think it may take several week to take and clear your fingerprinting from FBI so your interview only schedule after that and it may be November/december at that time your visa already available. I also notice that DV winner could apply at least 3 month prior whose number become current on that time frame. Some folks apply on october even their number current on september to maintain their status because once i-485 pending they don't need to worry about their other visa status and USCIS accept the adjustment package. So it's your choice weather apply on october or wait for november.

... But they do have to worry about applying early, and getting denied at the interview. :D
So, that's not just a choice, it's a risky option to apply early.
 
Yes, you are right Anhit, but only they could denied if the cut-off number still not available at the time of interview, they should follow the rules and they cannot denied because of only that reasion, we have the rights to ask them why other Immigration officer approved the case and why he is going to denied on the same situation, they need to give the denial letter and you have the rights to ask his Manager why he is doing this.

Wrong! The number should be available at the time of AOS submission. Here is an example of denial: http://www.immigrationportal.com/showthread.php?t=212811&highlight=early.
