AOS Interview

Hi:

I am married to a USC and am going in for the AOS interview in early June. My situation is a bit complicated so I would appreciate any kind advice that you guys can give:

I got married in Dec '03 when I was on an F-1 with my OPT set to expire on Mar '04. I was actively working at that point in time and have been dating my wife for over 3 years. Then I moved over to WA State (after marriage) and have been unable to secure a job yet. I am wondering about the following:

1. What all documents should I take to the AOS interview to make a strong case. Sad thing is that even though my situation is honest I am afraid the circumstances may not make it seem that way (for the AOS interviewers).

2. What kind of questions should my wife and I expect in this interview.

3. What happens in case I get rejected for the Green Card? Can I refile or do I have to leave the US with my wife?

I will really appreciate any help that you can provide me with.

hi can u give more details of ur case like when did u file and from where did u get ur recipt was it from MSC etc.

The INS will send you a list of documents you and your wife need to bring with you for your interview.

A list of common documents that come to mind are

1. Tax returns of you and your wife.
2. House Mortgauge or Apartment Lease papers
3. Bank Statements showing both your and her name.
4. Health / Life Insurance policies showing you and her as beneficiaries for each other.
5. Joint Credit Card accounts.
6. Utility Bills

INS won't deny your application based on the fact that your not working.

As for the questions : It can be any thing from how long do you know each other to where did you meet blah blah. If they suspect you guys aren't an ideal couple (which I hope not) they can have seperate interviews for you both (where they can grill you on your wifes life eg: her tooth brush color to her favorite restaurant.)

If your green card get's rejected you do have the option to re-file. Worst case scenario the INS can place you in removal proceedings. But let's just hope it dosen't come to this stage.

I had my interview 2 weeks ago and it was very smooth. My assumption is if you have your papers that are mandatory then the process is fairly simple. We dint get any questions except " where did u guys meet"? Even though we are not living in the same house all the time because of my job situation the officer did not question us at all. The officer's sees a lot of couples come there and they have a knack of knowing just by seeing you, if the marriage is fake.

So you should relax at the time of the interview because if you get nervous they might think something is wrong. So just take all the REQUIRED papers and go.
