Hi All! I need to have this clarified with your help if possible. If a person was granted voluntary departure in 2009 (student visa denied after staying in the US on J1 and B2 without home requirements) and did not leave the states, marries USC in 2012(after divorcing her husband non USC in 2011) files for AOS in March 2013. She did not file motion(I am not sure how its called) in the court to appeal that departure order. She is having interview in 4 weeks.
My question: Dont you have to file motion in front of the judge before an interview first? Or if she was called for interview that means without questions she's good? I got really confused and can't find it anywhere . I've also read that she could be arrested during interview and deported.
Well, basically I just want to know if you could be called for AOS interview if that VD order is till pending?Thank you
