AOS interview: USC Spouse' Birth Certificate asked

Hello all

My spouse is a Naturalized USC born in India. In my AOS interview notice, they have asked for Her Birth Certificate. We are unable to locate it. Please suggest is there any other alternate method for the same or wehave to follow the Non Availablilty Letter with Affidavits for her also.
Just curious isn't it possible to use her naturalization certificate or passport for the use.

Did you not use her birth Cert. to get her passport?? Did you not submited a copy of her birth Cert. when you file I 485?? If not then what did you submited? You can use that in place of birth Cert.

I guess we dotn need to submit the USC's Birth Certificate for the paperwork. I 485 just needed my BC because she is the sponsor and I am the beneficiary. So we didn't even care to get her BC located.

What do you mean by "unable to locate it?" Did she ever have a birth certificate? or is it lost? NABC can only be issued if the authorities can determine if a birth certificate was never issued to you and your birth was never registered with their records. If she does not have a birth certificate, she needs to do the same thing she did when she applied for her GC.

I-130 asks for the USC's birth certificate. How did you deal with that?

They should ask only the NATURALiZED certificate that your spouse got it t when he became a American.

When you file the application you attached a copy of the NATURALiZED certificate.


In the other hand if your spouse was BORN in the USA you would have to present the Birth certificate.
 
One of my friends has the same problem for Birth certificate. He didn't carry his Birth Certificate and they didn't pass him. So no matter what if they ask for PLEASE manage Birth Certificate. It's very easy in INDIA to get a birth certificate if you go to local registry office and they will issue it instantly, I heard. So don't take any chance. Birth certificate is the main thing for BCIS officer.

Another case: Recently my brother became US citizen. Whenever he went for interview, the officer was so nice and polite. After taking his interview she said you are all set but I am sorry I cannot give you the citizenship because in my record I don't have your birth certificate here. You have to bring it back and we will call you again. My brother said wait a bit probably I have a photocopy of my birth certificate. The lady was so excited and tell my brother give it to me and you are all set.

I-130 asks for the USC's birth certificate. How did you deal with that?

In 130 they need Birth Ceritificate only if the USC is born in States, else the Naturalization certificate or Passport is enough. She had her birth certificate but seems that she has lost it somewhere in India. Thats why I am worried about, because now when she is a USC from past two years Indian authorities i guess will also be unable to make a certificate for her.

I dont know why they are particular about the birth certificate when the person is already a citizen.

I dont think you should have any problems getting your spouse's birth certificate in India regardless of her current citizenship. Typically it is city municipalities and so on that make these and they have no way or verifying and dont care about the citizenship. If she had a birth certificate before, then they have a record and should be able to make a duplicate copy for you (possibly even hinting you to grease their palms in the process).
The reason immigration is particular about birth certificate maybe because of the way Indian names are structured. In many parts of India it is different from the system followed here where sometimes father's name is the last name or the order of name components makes it look like something else and so on.
But what about your spouse's n400, did they ask her for the birth certificate then? I'm unable to recollect if they did for my spouse.

If they already asked for the BC during the interview then you must give it to them doesn't matter if she already submitted her naturalization certificate (the interview has already a weight in your case), remember that during all this process the phrase "in case that we need more information/supportive documents..." so that is an open statement, do you have a specific time to get the document?
 
We are trying to find it but lets see if it works out.
As they have asked for the Birth Certificate so they have a right to put hold ont he case.
Reg Birth Certificate in India, I know what I have to go through to get BC in India and so I used the one we get from Indian Consulate. Metropoiltan city's people are smart now, they know the importance of the Certificate. So it didnt worked for me and how can i expect them to give it for USC.
 
What was your experience? Did your spouse require the birth certificate for the interview after all? I am pretty much in the same situation.
