AOS & H1 question.

Current Status: My labor & 140 got approved (Nov 2005). In the 6th year of H1 (till June 2006 - 6 months).

Question1 : When should I apply for AOS-Adj. of Status? Do I need to wait till 485 is current?

Question2 : Should I apply for 7th yr h1 extension first and then apply AOS

What is your PD? which country you are from?

In 6 months if your PD date is not current then you have to apply H extn..If it is current it is upto you to maintain H or not after applying AOS..

H1 exp: June 30, 2006

I dont expect 485 to be current in the next 6 months & hence, as per your posting, AOS cannot be applied.

So I have to proceed with 7th year (or 3 yrs if lucky) extension of H1.

My employer's policy is to file for H1 extension 2 months before its expiry.
Q 1) So, if they file extension in Mid May 2006 will that be sufficient time?
Q 2) Is receipt of H1 extension enough for 7th yr stay in US or should it be approved.
Q 3) Is there anything like Premium processing for 7th yr h1 extension?
 
You can apply for extension atleast 1 day prior to the end date of Ur current H1b. So no worry here.

As soon as U file U are good for 180 days --- [approval notice is not required for 180 days .]

Premium processing not required unless U or Ur employer have extra money to spend.
