AOS and its effect due to Company Name Change

I have filed by I-485 in Oct 2001 at VSC , the company has changed its Name effective Jan 2nd 2002 for Rebranding Purposes.


The Company Address remains the same and the Salary , benefits remains the same . The Company is willing to give letters
New Company name succeeds to the interests and Obligations of Old Company Name and the terms and conditions of employment of Mr. ABC remain the same including the employment status, salary and benefits.

1)Under these Circumstances would it be neccesary to file for a I-140 Amendment

2) Would one be eligible for AOS Portability(>180 Days)

You may need an affidavit

My company name changed 3 times after I started my greencard process. First time we filed affidavit at the time of I-140. Then again 6 months after filing 485 company name changed in Jan 2002. My lawyer said I don't need to file any affidavit at that stage and in case if I get RFE then file the affidavit. But I asked my lawyer to file affidavit in Feb and she did so. I didn't get RFE for company name but I got RFE for paystubs. My case approved in May, 20 days after filing resonse for RFE. Hope this will help.

May_485 , COuld you please share with us the format of the affidavit and also if these to be notarized or on a company Letter Head.

same thing happened to my co-worker

Our company changed its name before my co-worker filed for I485. Her H1B was still under the old company's name. So she received RFE regards employment letter, 3 months paystubs and evidence/report/proof that the new company is the same as the old company. Our HR dept. gave her the company's tax ID and some other legal documents. She got approved 1 month after she submitted her RFE. She just went back to her home country for a 1 month vacation.
