Anyway to expediate 485 - GC process for 5 1/2 years

Hello,

I came to USA as a student to do masters in 1991. After graduating and in HIB I became out of status, similar situation as war and the economy in 1992.

I applied for Labor certification in Jan, 1998 and got it approved in Dec 2000 under section 245(i)

I applied for 1-140 and after RFE got it approved in May 2002. I changed my attorney at this time.

Applied for I-485 on July 24th 2002. My receipt date is July 24th, 2002. I paid the fine amount of $ 1000.00. I have been working since Nov 02 with the EAD issued. The company sponsored is a small company and currently two employees work in the company including me. Job is pretty stable in this company.

I did not go to India in the last 12 years and right now my parent is sick and I would like to visit them. My attorney mentioned I will not be eligible for advanced parole since I was out of status before and the 3 year and 10 year bar will applied in my situation.

Is there any way of expediating the 485 process. Is there any way of asking the attorney to represent me to INS. My case is pending for 51/2 years. Desperately looking for answer.

Any suggestion, would be greatly appreciated.

Thanks for your kind reply. Do you know who is more powerful. Writitng to Congressman or Senator. I am planning to write to them this week. Keep you posted

I read your post again and realized that your I-485 is not pending for 5½ years. You applied for I-485 only last July. There are a large number of aspirants who applied for I-485 much before July 2002 are ARE STILL PATIENTLY WAITING. I think you should do the same. It is unfortunate that your LC, I-140 took so long.
Get advise from a good immigration attorney. I don't think a congressman/senator would be of much help because you violated immigration laws.
