Anyone's 140 Pending

Mine 140, substitute Labor
Recd date is 31 July 2002 (california).
Receipt date is 08/05/2002.
My 140 is pending. Is any there similar to mine.
Please let me know.

Pending since July 12,2002,CA.Subs Labor,I140 Filed alone.
How about yours?Is your I140 filed alone or Concurrent.If not filed concurrent,have you filed I485 after that?
 
Yes, mine is also filed alone. I haven't applied for 485. Just waiting for I140 to get approved. I am not sure what is hapenning. There is no RFE nor any reply.

later in October I filed AOS/AP/EAD concurrently using the 140 receipt.

Mine is pending since from 1 year.
My rd is 02/05/02.
Received RFE on 11/1/02
RFE Replied on 11/20/02.
RFE was regarding ability to Pay.
Still pending.

Did any of try to call the INS office regarding your case? If yes, how was the response. Can we call to ask about the status?

Can you tell me what the procedure for how to file for CP concurrently. How does that help compared to I-485.

My case has been approved by Feb 25, 2003. I check AVM tonight. But on-line web site has not been updated yet. Approval notice will be mailed within 14 days.

RFE Replied on 11/20/02.
INS Received RFE on 12/06/02

RFE is about ability to Pay.

Status: Pending. (waiting for a word... approved)

First of all congrats. Can you please post whether your labor was original or substitue one. Looks like mine should approve soon. I also send query on Feb 18th. INS Received response for RFE on 20th of Nov and yours was on 16th of November. If you don't mind can you post requirements asked by INS in RFE.

1st anniversary

I filed my I-140 on 11th march 2002.
Got RFE in June
Replied to RFE received by INS on 23rd July.
The online status says it will take 90 days.
It is alredy 7 months.
Still pending. Probably they might have lost my file. God knows.
I posted this in another forum and got the followng reply from an attorney.
'While it is not an absolute rule, the INS generally responds to I-140 RFEs within 6 weeks if it is going to be an approval. It usually takes longer for them to prepare a decision when they intend to not approve a case. This has many exceptions, so being prepared for an adverse decision while not giving up on the current I-140 is usually the best course of action.'

my case also is similar to yours-

LC done thru substitution
filed for 140. RD - 7/2002.
got RFE in 9/2002 abt company's financial status
company was not doing well at that time. they took 3 months to respond and finally sent the RFE in 12/1/2002 and INS recd the RFE reply on 12/16/2002.
INS website says it will take ~90 days.
no news yet. filed for I-485 last month. now the worst news.
company is relocating all engineers to india. so i am going to india and my company told me that they will keep my H1 status and also continue my GC processing.

can anyone please answer these questions-

1. how can i inquire abt my I-140 status. no point calling CSC number.ALWAYS engaged!!!

I heard that lawyers can fax them info, but not sure how they get back with info. I too have been trying very hard to reach them, but in vain. Some have adviced me to call as soon as office opens, which I guess is 9:00 AM. I just gave up. If it comes it comes. For me there was no RFE so far it is already 7 months and 14 days as of today. My lawyers say, wait.

We are in same boat. Applied on 02/05/02. RFE received on 11/1/02. RFE received by INS on 11/20/02.
Still waiting.
Applied I-485/ap/ead in october. Still pending.

Lets hope for the best.
