Anyone working/worked in NH/MN/ND J-1 waiver?

I will be working in NH for my J-1 waiver and came accross the rule that the Practice must not help facilitate LPR status for 2 years. Has anyone been in this situation?

My lawyer told me that since it is a non-binding state requirement and this does not appear in the federal regulations, which is the ultimate source of law for the J-1 waiver program we could atleast start with the intial steps. Will it be ok to do so?

The area I will be working in, recently lost its HPSA designation (after I got my J waiver done). Will I be eligible for NIW?

NIW in NH

I am in a similar situation . According to my lawyer it is ok as long as the application was approved prior to loss of designation. Of note I am on H1 and applied for NIW in HPSA due to lack of H1 time

I am currently in a similar situation as you mentionedin the above post, ie too liitle time on my H1 left, and might need to get NIW at a HPSA location. Kindly let me know how it works, most importantly, how soon do you have to apply before you run out of time on H1.

Your input would be greatly appreciated.

NIW in NH

I applied approximately 6 months in advance. Getting the paperwork ( esp letter from DOH ) together for NIW took another 2 months before that. I140/I485 were filed simultaneously. I also applied for an EAD which came theu in 3 weeks.
Important thing is to find a job !
