Anyone with a similar situation? Advise, please.

I got married to an american citizen in 2000. I applied to be naturalized on April, 2004. My case still in name check. We got divorced last month. I have not been outside the country, I have been in this country for 5 years. HOWEVER, MY APPLICATION TO NATURALIZATION WAS BASED ON MY MARRIAGE TO AN AMERICAN CITIZEN. I am still waiting for my name check to clear and get my oath letter. I have been waiting since my interview date December, 04.
Now I am divorced after 5 years of marriage and stay in the states. Should I keep waiting for my name check to clear and for the oath letter and no worries? Or should I submit a new application for naturalization on the basis that I have been 5 years and that my first application might be denied because I am not married any more?

Man... what's wrong with you. Just chill down and wait for your name check. You are fine, you don't have to file for a new application, because your marriage is done doesn't nullify your naturalization process. Additionally, when you receive your letter of oath, you will be required to check some questions on whether anything has changed since the interview, and be truthful. I am not sure, the may be a question on whether your marital status has changed, answer yes.

Please be forthright and you will be fine. If you lie in these final stages, and the USCIS finds out after you have naturalized, they can revoke your citizenship. I believe that the courts have confirmed that if anyone procure their US citizens on false information, the USCIS has the power to revoke that citizenship.

In your case, you are fine and wait for your name check to clear and enjoy your new citizenship.

Thank you Al Southner for your response. I also would like to thank each of Suzy977, JoeF, and ari4u. You are such a great relief and support. I was not intending to lie or not to be truthful. I am just confused. I asked two attorneys here in San Diego about my case and both told me that I have to reapply on new basis, the 5 year base and because I am not married any more. One of the two attorney told me that the name check for the new application will be starting from ground zero....that made me feel bad. My name check has been pending for two years now. To ask me to re apply from beginning and restart all over.....?!!

Another 2 attorneys in San Diego too told me that I should not be worried and I should wait for my oath letter when it comes. They told me that the San Diego DO is flexible and they might ask me to "fee- in" for another application before I swear in. I became totally confused.

Anyone who has been through the same? File for naturalization on marriage to US citizen basis, gone through the interview, and after 5 years of stay and marriage got divorced before the oath ceremony.....?!
