Hi,

I currently use EAD, Visa from my previous H1 on the passport expried and i could not renew, as I used EAD.

1. Anyone travelled to India with expired visa on the passport and have a valid AP..

2. Also, my FP expires March 1st week. I do not think, i will be getting notice for 2nd FP before I leave in Feb as at that time, it is not expired.
So when i come back in March, will it be a problem with expired FP??..

Please share your experiences, i need to go home ASAP..

[Sri] My FP is already expired, I guess. I didn't get second FP notice yet and I don't think I will get it before I leave for India.

1. When entering the country all you need is a valid travel document. In your case it is the AP. Since you have used your EAD, you have lost your status as a H1 and now HAVE to use AP to enter the country. So the expiry or not of your H1 is moot!

2. FP has nothing to do with your AP or your entry into the country. Though I would advise you to request re-fingerprinting at the soonest, just because you don't want to delay your 485!

3. Expiry of I94 is moot once you are an adjustee, PLEASE USE the SEARCH FUNCTIONALITY for more information on this, we have already discussed this issue like 4 times in the past week.

Travel on valid AP while another AP is pending is a completely different ball game. I am sure you are following the other threads where we discussed this issue. Different people (all of whose opinions I respect), have different views on this issue. Personally, having known people who have been in your shoes, gone abroad and entered the country, and received approvals in due course of time, as well as thinking about the problem logically, I believe that you shouldn't have any problems.

Though being such a sensitive issue, I would definitely advise you to discuss this with your lawyer before making any life altering decisions. Also if you have any other questions on this regard, open a new thread on it since that matter is very different from the current thread.

No, I did not apply for any renewal of AP. I have a valid AP and thats it. I touched that issue since I thought it was worth mentioning. I'm sure there would be some who don't know about this catch.
