I came across a new theory from my attorney last Friday. Which is :

If your Priority date is close to the I485 processing dates, then even if you filed your I140 recently, you case will have good chance of being processed compared to the I140 which might be filed 9 months ago ans still be waiting.

For example :
LC filed in May,2001
LC approved Jan, 2004
I140, I485 filed in Feb, 2004
And current processing times for I485 is Jun,2001.
which means you will have immigrant visa numbers available for your I485.
Which eventually triggers to process your I140, even though your Receipt date is Feb,2004 and current processing for I140 is Feb, 2003.

This is the theory from my Attorney. so, checkout your Priority dates...as well.

Jaidev,

Is there specific reason behind applying for semi-concurrent? Just curious. My attorney suggested this path and I did file semi-concurrent.

Do you know for sure (100% guaranteed) that semi-concurrent filing alos eligible for AC21 portability?

some_greencard,

As per logic, YES.

IF all labor substitutions goes through a different stream of certifying officers, then it might get delayed. ...just my thought...

There may be complications if the there is heavy delay (in years rather months) after labor is certified and I140 is filed with substitution....don't you think?

Even after ready so many threads, I am sure no one can comeup with any specific logic that INS would apply for processing. This is just attorneys view/knowledge based on experience out of dealings with INS.

He might be wrong too.....

Advantage.

I dont know wheather there is advantage in applying Semi-Concurrent,but my lawyer recommanded in applying for Semi-Concurrent.

I heard that People who applied for Semi-Con are getting their I140 approvals faster than Concurrent..is it true ???

Thanks
