I read in the San Jose Timeline that the San Jose office does not do name changes any more for N400.

Does anyone know:

1) how to get name change done?

2) where to go to get the name change done?

3) how long it takes to get the name change done?

Thanks for the help :)

1. Go to court and they'll give you all the forms and instructions

2. Court

3. 6 weeks

thanks :)

Thanks for the information supernet. Appreciate it.

Now, is it advisable to get this done before the naturalization oath?

This way, I can change the N400 application during the interview to my newly changed name?

did you already file for n400!
You can apply for name change while applying for naturalization. This is the easiest way,the normal way(going through court)is a very lengthy and tedious process...
if you have allready applied for n400,you might call the 1800 number and check with them as to what is the process for a name change at the time of the interview, but i have never across a case where people have directly gone t the interview and requested a name change .

Hi query11..thanks for your input. If you read pg.49 of the San Jose Timeline thread, someone there said that the San Jose CA office does not process name changes any more for N400 even if you ask for a legal name change to happen.

Therefore, my question is whether it is a good idea to just get the name change done now (even before the interview happens, oath etc). I have already filed my N400 and is currently making it's way through the process.

Thanks.

hmm,
you are right...
Q. Why can’t I change my name during the citizenship process?
A. The U.S. Northern California District Court previously presided over the naturalization of new citizens in the San Jose jurisdiction. However, in August 2004, this court decided that they would no longer participate or preside over the naturalization of new citizens of the San Jose USCIS office. Their past involvement also included the authority to change names. USCIS does not have the authority to change names and as a result, name changes cannot be made in our office. Persons interested in changing their name must do so with the State of California prior to or after becoming naturalized.

>>>>

If a name change occurs after the new citizen becomes naturalized and wishes to change the name on the naturalization certificate, he or she may file the N-565 for a replacement certificate in our office. We will continue to honor name changes due to marriage or divorce.

sorry, since you have allready applied i guess take a infopass and talk to them.
....if i were you since the appliction is alredy in the process i would just wait however plz refer to a couple of other people before you have a final go.

also make it a point to schedule a infopass asap
good night

Hi happigal,
If I am in your situation, I will do the name change afterward and don't put two legal name on N-400 because that may/will delay you name check process since they have to check you background for two names instead of one.

Wait until you become Citizen, and then get a passport with the old name, then file for name change then request a replacement passport with the new name and this service is free if within one year.
Good luck.

hi Sams68...actually I did a little research and it looks like you have to first file with the courts to have your name changed (cost $320) and then file a N565 "Application for Replacement Naturalization Citizenship Document" (cost $220) and then get your passport (or replace passport if you already filed for one).

I am still thinking if I really want to change my name since it's just my middle name which isn't as important as say a last name.

Good luck if you're still thinking about changing your name. I still think San Jose DO should do it for us but that's my opinion :D
