anyone join school after applying I-485

I would like to known how they treat you as US Resident or
Foreign student.( What Fees they charge you) ???

they will charge you foreign student fees.. After you get your GC and if you go to a state university and you reside in the state then you will be charged resident fee

You might want to check with the university for its residency requirements.
 
Also depends on H1 or H4 or EAD

H4's are not allowed unless they have GC (else forieng student fee's). H1's and H1 to EAD's are allowed to pursue studies. State and university policies differ sometimes. In some states GC is a must else foreigner fee structure. Some states require residency (not permanent residency/GC), etc for in state fee. Thus, depends on State/University/Community College/Private University, etc.
 
applying to grad school on EAD status

Could you clarify more about studying in a grad school on EAD
please ? I was under impression that EAD is only for work
purposes and one can not study using EAD.

Right now I am using my EAD to work and expecting my GC to
get approved by end of this year (Rd nov'01). I am planning to
attend grad school from fall 2003 for which I have to submit
applications before December this year to be eligible for financial
aid. I wonder what should i have to write as my immigration
status on the application form. Most of the grad school
applications have option of US citizen, US Permanent Resident,
and Non-US (and specify the type of the visa). Now what's about
someone with the EAD ?

A Few thoughts...

Hi,
The difference between going to school on H-1B and EAD.

1. On H-1B, you cannot attend school as a FULL TIME student. For that you have to convert to F-1 status. You can only go to school part time but you should be primarily working( that way you are maintaining legal visa status).

2. On EAD, you can go to school FULL TIME, without working, though you may not want to state this to INS because the intention of issuing an Employment based green card is for future employment.


So if you go to school after obtaining your EAD, it may not cause problems until INS issues an RFE for Pay stubs,W-2 and employment letter. At that point of time, if you are able to prove to INS that somebody is willing to hire you, then you'll be able to get your GC without any problem.
But if your case gets transferred to the local INS office then they may want to see you being employed with some company.

Check out University of CA ....it even considers H4's as residents if they have been in CA for more than 1 year. You can check out other Univ.'s .......
