hi all,

I filed my petition on april 2, 2007 and assumed my petition was file under master's degree quota. However, until now I haven't received any news in regards to my petition.

Does it mean my file got rejected?
Is there any of you is in the same situation with me?

Please kindly reply.. Thank you.

Lets take it up with USCIS

My wife was rejected even though her application was filed as Master's. The application reached USCIS on April 2nd. It definitely seems like a mistake by USCIS when sorting the applications. We are going to resend the the application (not sure if it is a motion to reconsider).

Should everyone that is affected by this get together and raise our concern with USCIS? I am sure with some help from experts (such as Rajiv Khanna) we could do something about this. I personally think it is unfair that a person that applied for an H1 under the advanced degree towards the fag end gets a H1 simply because things "slowed down" whereas a person that applied much earlier gets rejected due to sorting issues.

Too many such cases

Since the last time I posted, a number of students have been affected by this problem. I do not see a lot of activity in this portal regarding this issue but I do see it in other forums. I think USCIS should accept all applications that were incorrectly rejected in the lottery even though they were Advanced degree applications, receipt and process these applications.

Any lawyers that can help us here?
