Anyone filed 245(i)?

Did anyone have to file 245(i) for being “out of status” in the past?
How did you prove physical presence in the U.S. on December,21 2000 ?

I have been in the same situation, the only way you can prove is wiht your I94, you need that more than air, if you have lost it there is some way lawer can help you get a copy of that, good luck

That year I went to India for Christmas and came back into the U.S. on Jan 2, 2001 so my I-94 date says Jan 2, 2001.

How can that help me prove that I was in the country on December 20, 2000?

There must be another way.

My attorney told me that the INS does not check this. All the want if the $ 1,000 penalty fee plus form I-485A.

Please let me know what you've heard...
 
i do not think so it is that easy, i think they are very perticular about this, and as is it you had to file before april 30 2001, if you have not done that, you should just forget about getting the gc that way. find some other way, best of luck
 
Sorry, but you are giving wrong info.
What had to be filed before April 30, 2001 was either a labor certification or a visa petition (I-140).

If you filed your labor or I-140 before April 30, 2001...

...then just give it a try by filing 485A with $1000. I believe that we don't have to prove anything. INS will find out whether you were physically present or not.
