My 1st I-140 has priority date of Oct 2000.
My 2nd I-140 has priority date of Oct 2002.
Sec. 204.5 (e) "Retention of section priority date" says we are all allowed to retain the FIRST priority date.
Now, lawyer screwed up, so the 2nd I-140 got it's own (new) date of oct 2002. The case has gone to the consulate and is stuck because of 1 Jan 2002 cutoff date for EB3. No interview will be scheduled.
I spoke to USCIS today morning and they refused to do anything about it. The lawyer is saying he'll try to convince consulate to honor older priority date. Should I believe him?
Has anyone convinced the consulate to honor the older priority date?
I'm desperate and it's urgent. Any help will be deeply appreciated!
